Acceptance of Terms

By accessing or using the Bossmetics platform (bossmetics.com, partners.bossmetics.com, my.bossmetics.com, and associated services), you agree to be bound by these Terms of Use. If you do not agree, you may not use our services. These terms apply to all users: beauty professionals ("Professionals"), their clients ("Clients"), and visitors to our website ("Visitors").

Description of Services

Bossmetics is a software-as-a-service (SaaS) platform for beauty professionals. The platform provides: • Online booking and calendar management • Client relationship management (CRM) • Payment processing and invoicing • Staff management and scheduling • Inventory and retail management • Marketing and promotional tools • Loyalty and membership programmes • Analytics and reporting • Forms, waivers, and digital signatures • Treatment plan management • Multi-location management • Marketplace discovery The specific features available depend on the subscription plan.

User Accounts

To use the Bossmetics platform, you must create an account. You are responsible for: • Providing accurate and complete registration information • Maintaining the confidentiality of your login credentials • All activities that occur under your account • Notifying us immediately of any unauthorised access You must be at least 16 years old to create an account. Professionals must have the legal authority to operate a business in their jurisdiction.

Professional Responsibilities

Professionals using Bossmetics are responsible for: • Complying with all applicable laws and regulations in their jurisdiction, including business licensing, health and safety regulations, and tax obligations • Obtaining appropriate consent from their clients before storing personal data, particularly health-related data (allergies, treatment records) • Ensuring that any health waivers, consent forms, and data processing notices used through the platform comply with local requirements • The accuracy of their service descriptions, pricing, and availability • Managing their own staff members' access and permissions appropriately Bossmetics is a tool to assist you in running your business. We do not provide legal, tax, medical, or business advice.

Client Responsibilities

Clients using the Bossmetics booking platform are responsible for: • Providing accurate contact information • Honouring confirmed appointments or cancelling within the Professional's cancellation policy • Disclosing relevant health information (e.g., allergies) when requested by the Professional • Complying with the individual Professional's terms and policies

Acceptable Use

You agree not to: • Use the platform for any unlawful purpose • Upload content that is defamatory, obscene, or infringes intellectual property rights • Attempt to gain unauthorised access to any part of the platform or its infrastructure • Interfere with or disrupt the platform's performance or security • Use automated scripts, bots, or scrapers to access the platform • Impersonate any person or entity • Use the platform to send unsolicited commercial communications (spam) • Reverse-engineer, decompile, or disassemble any part of the platform We reserve the right to suspend or terminate accounts that violate these terms.

Intellectual Property

The Bossmetics platform, including its design, code, features, logos, and documentation, is the intellectual property of Bossmetics and is protected by copyright, trademark, and other intellectual property laws. You retain ownership of all content you upload to the platform (photos, documents, business information). By uploading content, you grant us a limited, non-exclusive licence to store, display, and process it as necessary to provide our services. You may not copy, modify, distribute, or create derivative works from any part of the Bossmetics platform without our prior written consent.

Data Processing

When a Professional uses Bossmetics to manage client data, the Professional is the Data Controller and Bossmetics is the Data Processor under GDPR. Our data processing practices are described in our Privacy Policy. For Professionals processing client data through the platform, our Data Processing Agreement (available upon request at privacy@bossmetics.com) governs the relationship. Professionals are responsible for ensuring they have a lawful basis to process their clients' personal data and for fulfilling data subject rights requests related to data they control.

Limitation of Liability

To the maximum extent permitted by applicable law: • Bossmetics shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform • Our total liability for any claim arising from or related to these terms shall not exceed the total amount paid by you in the 12 months preceding the claim • We are not liable for any loss of revenue, data, or business opportunities resulting from service interruptions, errors, or third-party service failures Nothing in these terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

Indemnification

You agree to indemnify and hold Bossmetics harmless from any claims, losses, damages, or expenses (including legal fees) arising from: • Your use of the platform in violation of these terms • Your violation of any applicable law or regulation • Any dispute between a Professional and their Client that does not involve Bossmetics as a party • Content you upload to the platform that infringes third-party rights

Modifications to the Service

We may modify, update, or discontinue features of the Bossmetics platform at any time. We will provide reasonable notice for material changes that affect your use of the service. We may update these Terms of Use from time to time. Material changes will be communicated via email at least 14 days before taking effect. Continued use of the platform after the effective date constitutes acceptance of the updated terms.

Governing Law and Disputes

These Terms of Use are governed by the laws of [your jurisdiction]. For EU consumers, mandatory consumer protection laws of your country of residence apply in addition. We encourage you to contact us at hello@bossmetics.com to resolve any disputes before initiating legal proceedings. Disputes shall be subject to the exclusive jurisdiction of the courts of [your jurisdiction], unless mandatory EU consumer protection rules provide otherwise.
